Das Wort ist bewusst gewählt: orientiert, nicht „beaufsichtigt“, „lizenziert“ oder „zugelassen“. FinCore Engine ist ein Softwareanbieter und steht als solcher nicht unter der Aufsicht der Bundesanstalt für Finanzdienstleistungsaufsicht. Diese Seite erklärt, was der Begriff hier tatsächlich meint — und was er ausdrücklich nicht meint.

Was „BaFin-orientiert“ nicht bedeutet

FinCore Engine besitzt keine Erlaubnis der BaFin, ist nicht von der BaFin beaufsichtigt und wurde von der BaFin nicht geprüft, zertifiziert oder gebilligt. Es besteht keine Einlagensicherung und keine Anlegerentschädigung. Wer Ihnen etwas anderes erzählt, irrt.

Was es bedeutet

Die Software ist bewusst so entworfen, dass sie unterhalb der Erlaubnisschwelle bleibt und die aufsichtsrechtliche Stellung der Berater, die sie einsetzen, nicht gefährdet.

Keine Anlageberatung durch die Software

Anlageberatung ist die Abgabe persönlicher Empfehlungen zu Geschäften mit bestimmten Finanzinstrumenten — und erlaubnispflichtig. Die Plattform gibt keine solchen Empfehlungen ab. Sie zeigt eine Prognose und eine Lücke; sie nennt kein Produkt, keinen Anbieter und keine ISIN und rät zu keinem Kauf oder Verkauf. Diese Grenze ist der Grund, warum die Bewertung deterministisch und produktneutral gehalten ist.

TIPPGEBER-ABGRENZUNG

Vermittlung endet bei der Kontaktherstellung

Die Plattform stellt auf Wunsch des Kunden den Kontakt zu einem Berater her und beschränkt sich darauf. Sie führt keine Vertragsverhandlungen, nimmt keine Willenserklärungen entgegen und wirkt am Abschluss nicht mit. Diese Tippgeber-Rolle ist in den AGB ausdrücklich festgeschrieben, damit sie nicht im Betrieb verwischt.

§ 1 ABS. 1 KWG

Keine Bankgeschäfte, kein Zahlungsverkehr

Die Plattform verwahrt keine Gelder, führt keine Konten, nimmt keine Einlagen entgegen und wickelt keine Zahlungen zwischen Kunde und Anbieter ab. Erfasst werden ausschließlich vom Kunden eingegebene Werte — es fließt kein Geld über die Plattform.

Keine Renditeversprechen

Aufsichtsrechtlich wie wettbewerbsrechtlich gilt: Darstellungen dürfen nicht irreführen. Überall dort, wo Zahlen erscheinen, steht der Hinweis, dass sie beispielhaft sind, keine Anlage-, Rechts- oder Steuerberatung darstellen, dass Renditen nicht garantiert sind und frühere Wertentwicklungen kein verlässlicher Indikator für künftige Ergebnisse sind. Die Prognose rechnet laufende Kosten mit ein, statt sie auszublenden.

NACHVOLLZIEHBARKEIT

Deterministische Regeln statt undurchsichtiger Bewertung

Ampel und Prognose folgen festen Regeln, die bei gleichen Eingaben stets zum gleichen Ergebnis führen. Das ist die Voraussetzung dafür, dass Sie einem Kunden — oder im Zweifel einer Aufsicht — erklären können, wie eine Aussage zustande gekommen ist.

Wer hier tatsächlich beaufsichtigt wird

Die aufsichtsrechtliche Stellung liegt bei den handelnden Personen und Unternehmen, nicht beim Werkzeug.

Für die meisten Berater, die mit dieser Plattform arbeiten, ist die zuständige Aufsicht die örtliche Industrie- und Handelskammer, nicht die BaFin. Eine BaFin-Erlaubnis nach § 15 WpIG brauchen Sie nur, wenn Sie Anlageberatung oder -vermittlung außerhalb des Bereichsausnahme-Rahmens des § 34f GewO erbringen.

BaFin aware

The wording is deliberate: aware, not "supervised", "licensed" or "authorised". FinCore Engine is a software provider and as such is not supervised by BaFin, the German Federal Financial Supervisory Authority. This page explains what the term actually means here — and what it expressly does not.

What "BaFin aware" does not mean

FinCore Engine holds no BaFin authorisation, is not supervised by BaFin, and has not been examined, certified or approved by BaFin. There is no deposit guarantee and no investor compensation scheme. Anyone telling you otherwise is mistaken.

What it does mean

The software is deliberately designed to stay below the authorisation threshold and not to jeopardise the regulatory standing of the consultants who use it.

§ 1(1A) KWG · § 2(2) WPIG

No investment advice from the software

Investment advice means giving personal recommendations on transactions in specific financial instruments — and requires authorisation. The platform gives no such recommendations. It shows a projection and a gap; it names no product, no provider and no ISIN, and advises no purchase or sale. This boundary is why the rating is kept deterministic and product-neutral.

THE REFERRER BOUNDARY

Intermediation ends at making the introduction

At the client's request the platform puts them in touch with a consultant, and confines itself to that. It conducts no contract negotiations, accepts no declarations of intent and takes no part in concluding a contract. This referrer role is written expressly into our terms so that it does not blur in practice.

§ 1(1) KWG

No banking business, no payment handling

The platform holds no funds, operates no accounts, accepts no deposits and settles no payments between client and provider. Only values entered by the client are recorded — no money moves through the platform.

MARKETING & PRESENTATION

No promises of returns

Both regulatory and competition law require that presentations must not mislead. Wherever figures appear, they carry the note that they are illustrative, do not constitute investment, legal or tax advice, that returns are not guaranteed and that past performance is not a reliable indicator of future results. The projection factors in ongoing costs rather than hiding them.

TRACEABILITY

Deterministic rules instead of opaque scoring

The traffic light and the projection follow fixed rules that always produce the same result from the same inputs. That is the precondition for being able to explain to a client — or if it comes to it, to a regulator — how a statement came about.

Regulatory standing attaches to the people and firms acting, not to the tool.

For most consultants working with this platform, the competent authority is the local Chamber of Industry and Commerce (IHK), not BaFin. You need a BaFin authorisation under § 15 WpIG only if you provide investment advice or broking outside the exemption framework of § 34f GewO.
